LightGuide, Inc., LLC (“LightGuide,” “we,” “us” or the “Company”) has issued this Global Data Protection and Privacy Policy (“Policy”) to describe how we handle personal information that you may provide to us.

We respect the privacy of individuals and are committed to handling personal information responsibly and in accordance with applicable law. This Policy outlines the personal information that we collect and process about you, why we process the information and the rights you have regarding the collection of your information.

2. The Information We Collect

We collect basic information which identifies you as an individual (“Personal Information”), such as your name, email address and phone number, mailing address, and credit card or other billing information, in order to transact business with you, on behalf of the company you work for, as our customer. We will use Personal Information for providing you information which you have requested, fulfilling business transactions or for other purposes set out in this Policy.

We may also collect Personal Information indirectly for third parties, such as our business partners.

 

2.1 User-provided Information:

When you use our websites (https://ops-solutions.com/ or https://www.lightguidesys.com/) and our products you may provide, and we may collect Personal Information. Examples of Personal include, name, email, phone number, company or organization, job title, and credit card or other billing information. Personal Information also includes other information, such as geographic area or preferences.  You may provide or we may collect IT information required to provide access to systems and networks such as IP addresses, log files, and login information. We may also collect information pertinent to fulfilling business transactions on a customer’s behalf.

When you visit our website, we may automatically record certain information from your device by using various types of technology, including cookies, “clear gifs” or “web beacons.” This “automatically collected” information may include IP address or other device address or ID, web browser and/or device type, the web pages or sites visited just before or just after using the website, the pages or other content the User or Visitor views or interacts with on the website, and the dates and times of the visit, access, or use of the website. The information may also include company name, location and industry if applicable. This information is gathered from all visitors.

We may receive/collect information, including Personal Information, from third parties and sources other than our website such as our partners, and trade shows. We will treat all Personal Information in accordance with this Policy.

3.1 Business Transactions with Customers                                      

We process Personal Information through our global IT systems, which includes tools and systems to help us to manage customer accounts, orders and business transactions. It also shares information across our Company systems, and with related corporate entities, as describe in section 4.1 below.

 

3.2 OPS Solutions Websites, Marketing, Subscriptions, Social Media

You may provide Personal Information to the Company through our website “contact” page, to request product information, or other resources such as product demos, or documentation. Personal Information gathered from the forms you fill out on our website is used in any of the following ways:

  • To provide you with information about our products and services, including product alerts, releases, and upgrades.
  • To access customer support portals or participate in a Blog.
  • To aggregate broad demographic information to understand general user trends.
  • To enable our compliance with export control and other laws and regulations.

We may make use of Personal Information that we collect to help us administer the website and/or for marketing purposes. We may send you information about products that might be of particular interest to you, product updates, promotional and informational e-mails.

3.3 Other legitimate business purposes

We may also collect and use Personal Information when it is necessary for other legitimate purposes, such as to help us conduct our business more effectively and efficiently, for example, for general  IT resourcing on a global level and information security/management.

We also may use your personal information where we consider it necessary for complying with laws and regulations, or to exercise or defend the legal rights of the Company’s global group of companies.

 

3.5 Analytics

We use a tool called “Google Analytics” to collect information about use of this site. Google Analytics collects information such as how often users visit this site, what pages they visit when they do so, and what other sites they used prior to coming to this site. We use the information we get from Google Analytics only to improve this site. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

 

4.0 Who We Share Information With

 

4.1 Within OPS Solutions, LLC.

Employees, contractors and agents of the Company may be given access to Personal Information which we collect, but their use will be limited to the performance of their duties and the reason for processing. Our employees, contractors and agents who have access to your Personal Information are required to keep that information confidential and are not permitted to use it for any other purposes.

Personal Information may be shared among OPS Solutions, LLC subsidiaries, the Company’s subsidiaries include: Light Guide Systems Europe sro (Czech Republic) and Light Guide Systems (China).

 

4.2 Business Partners

We will never sell, rent or disclose to unaffiliated third parties your Personal Information unless we have your permission or are required by law to do so. When we permit a third party to access Personal Information, we will implement appropriate measures to ensure the information is used in a manner consistent with this Notice and that the security and confidentiality of the information is maintained.

We disclose the Personal Information we collect to the following third parties:

  • Business partners for the purposes of providing services, support and products to customers.
  • Third parties where disclosure is required or authorized by law

 

4.3 Lawful Grounds

We may disclose Personal Information to third parties on other lawful grounds, including:

  • To comply with our legal obligations, regulation or contract, or to respond to an administrative or judicial process

5.0 Controlling Your Personal Information

You can request correction, update and deletion of your Personal Information via e-mail sent to [email protected], and we will use reasonable efforts to contact you regarding your request. To update or delete your Personal Information or correct an inaccuracy, we may ask you to verify your identity and cooperate with us in our effort.

 

6.0 EU Residents Only

 

6.1 Transfer of Personal Information

As we operate at a global level, we may need to transfer Personal Information to countries other than the ones in which the information was originally collected. When we export your personal information to a different country, we will take steps to ensure that such data exports comply with applicable laws. For example, if we transfer personal information from the European Economic Area to a country outside it, such as the United States, we will implement an appropriate data export solution such as entering into EU standard contractual clauses with the data importer or taking other measures to provide an adequate level of data protection under EU law.

If we have collected and processed your Personal Information with your consent, then you can withdraw your consent at any time.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

Personal Information will be retained no longer than necessary in relation to the business purposes for which such Personal Information is provided and to fulfill legal requirements.

We are committed to ensuring that your information is secure. We have put in place appropriate technical, physical and administrative procedures to safeguard and secure the information we collect in order to prevent unauthorized access or disclosure.

We reserve the right, in our discretion, to make changes to any part of the website or this Policy. We may change the Policy from time to time by updating this page. You should check this page from time to time to ensure that you are aware of any changes. This notice is effective from May 25, 2018. By continuing to use the Company’s website and business services, you consent to this Policy as amended.
